Welcome to SureRide! These Terms and Conditions govern your use of our on-demand cab booking services through the Customer App, Driver App, and our website, sureride.com.au. By accessing or using our services, you agree to be bound by these Terms and Conditions.
1. Definitions
- “SureRide” refers to SureRide, the provider of cab booking services.
- “Services” refers to the cab booking services provided through the Customer App, Driver App, and website.
- “User” refers to any individual or entity using our Services, including customers and drivers.
- “Customer” refers to an individual who books a cab using our Services.
- “Driver” refers to an individual providing transportation services through our platform.
2. Eligibility
- Users must be at least 18 years old to use our Services.
- Drivers must hold a valid driver’s license and all necessary certifications required by law in Western Australia.
3. Account Registration
- Users must register for an account to access our Services.
- Customers must provide accurate and complete personal information during registration.
- Drivers must provide accurate and complete information, including valid driver’s license details, vehicle information, and necessary certifications.
- Users are responsible for maintaining the confidentiality of their account credentials and for all activities under their account.
4. Use of Services
For Customers:
- You may book rides through our Customer App or website.
- You agree to pay the fare displayed at the time of booking.
- You must not use the Services for any unlawful or prohibited activities.
For Drivers:
- You agree to provide transportation services in a safe, professional, and lawful manner.
- You must maintain the required insurance coverage and certifications at all times.
- You agree to keep your vehicle in good condition and comply with all local laws and regulations.
5. Payments
- Customers authorize SureRide to charge the payment method provided for the fare and any applicable fees.
- Drivers will receive payment for completed rides, minus SureRide’s service fee.
- All payments are processed securely through our third-party payment processors.
6. Cancellations and Refunds
- Customers may cancel a ride within a specified period without incurring a cancellation fee.
- Cancellation fees may apply for late cancellations or no-shows as per our cancellation policy.
- Refunds will be processed in accordance with our refund policy, available on our website.
7. Ratings and Reviews
- Customers can rate and review drivers after each ride.
- Drivers can rate and review customers.
- All ratings and reviews must be fair, truthful, and respectful.
8. Prohibited Conduct
- Users must not engage in any behaviour that is illegal, harmful, or disruptive to the Services.
- Prohibited conduct includes, but is not limited to, harassment, fraud, discrimination, and misuse of the platform.
9. Intellectual Property
- SureRide retains all rights to its intellectual property, including but not limited to trademarks, logos, and software.
- Users must not use SureRide’s intellectual property without prior written consent.
10. Limitation of Liability
- SureRide is not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Services.
- SureRide’s total liability to any user for any claims arising out of or related to our Services is limited to the amount paid by the user in the three months preceding the claim.
11. Indemnification
- Users agree to indemnify and hold SureRide harmless from any claims, liabilities, damages, and expenses arising out of or related to their use of the Services.
12. Termination
- SureRide reserves the right to suspend or terminate a user’s account at any time for any reason, including violation of these Terms and Conditions.
